Oakland teens with gun arrested near UC Berkeley stadium

Two young men from Oakland have been charged with having a gun on UC Berkeley property after parking near Memorial Stadium with an open container, according to court papers.
Earlier this month, on Sept. 11 shortly before 9 p.m., UCPD officers on patrol said they noticed a gray Mercedes parked with its door open near Stadium Rimway and Centennial Drive.
Inside the car, the officers noticed an open malt beverage called Four Loko in the center console, UCPD wrote.
One of the officers asked the driver, identified as 18-year-old Peyton Guitano Adragna, for his registration.
That's when the other officer noticed a gun tucked into the passenger side door panel, police wrote in charging papers.
When the officers inspected the gun, they determined it had been stolen in an auto burglary in Boise, Idaho, police wrote.
The black Glock 22 was loaded with 10 live rounds, according to UCPD.

Adragna told police the gun belonged to a friend, and said he only had it because his friend couldn't take it to work, police wrote in charging papers.
He did not know the gun was stolen, he said.
He also told police his passenger, 19-year-old Adam Garcia Ibarra, had not been aware of the gun (even though it was in the door panel beside him), police wrote.
When UCPD spoke to Garcia Ibarra, he said Adragna had shown him the gun "near a freeway in Oakland," according to charging papers.
Garcia Ibarra said he held the gun but then "forgot he left it in the side door panel," police wrote.
He told police he "knew Adragna shouldn't have had the firearm but he thought it was cool."
On Sept. 15, the Alameda County district attorney's office charged both men with three felonies: possession of a firearm in a school zone, carrying a loaded firearm in public and carrying a concealed firearm in a vehicle, according to court records.
The charges include allegations that the gun was stolen and unregistered.
Both men were arraigned on the charges last week and entered pleas of not guilty.
According to court records, Garcia Ibarra was released on his own recognizance and Adragna posted a bond for $160,000 bail.

In a letter to the court, Adragna's attorney promised that his client would behave while out on bail.
"Peyton is not a flight risk nor a danger," wrote SF-based attorney Christopher J. Cannon of Sugarman & Cannon. "He lives with his parents in a home the family has owned since 2015. He attends Laney college through the Gateway to College Program and I am unaware of any prior criminal record. He is appearing today and will appear if and when he is told to appear in the future."
A condition of his bail includes staying 100 yards away from the UC Berkeley campus, according to court records.
Both men are set to return to court Oct. 22 for a pretrial hearing.
