Despite the widespread attention, [Berkeley police](https://www.berkeleyscanner.com/topic/berkeley-police-department/) say there was no contact between the two. They have classified the incident as misdemeanor trespassing. The student later posted a sped-up version of the security footage on TikTok, where it has been viewed more than 2 million times. The incident took place last week as Cal student Eden Winograd began walking her dog on Berkeley Way at about 8 p.m. Sept. 15. Shortly after she went outside, an unhoused man "ran toward her," she told police. Winograd went back to her off-campus apartment building, just a block from UC Berkeley, in the 1900 block of Walnut Street. But seconds after she closed the security gate leading into the lobby, the man climbed over it and came inside. Winograd made it into the elevator and went home. Winograd said she believed the man was chasing her. She'd seen him around before, she said on TikTok, and he often zeroed in on her. "What I went through is him chasing me down the street," she said [in a recent post](https://www.tiktok.com/@edenwinograd/video/7687678472524795166?ref=berkeleyscanner.com). "I heard his feet behind me." Police said they could establish only that the man ran in her direction before entering her building, where he had been sleeping. Security had already kicked him out of the garage once, police said. That night, it took police more than an hour to respond. Officers "were occupied with other priority incidents, including a missing autistic child and a domestic violence incident," the department said last week in a prepared statement. Frustrated, Winograd posted an edited clip of the building security footage on TikTok, speeding up parts of the video and slowing down the moment when the man pulled an object from his pocket. She also added dramatic music. "I don't want to be chased and have to watch someone claw their way up a wall to get into where I live." When police did respond, they were unable to find the man who followed her. (As it turned out, he slept in the building garage that night, Winograd said in a TikTok post.) After reviewing the security footage the next day, police first thought the man might have been holding a bladed object. They later determined it was "likely a barbecue lighter." Officers ultimately classified the case as trespassing, which is a misdemeanor. The next night, Winograd spotted the man sleeping on the sidewalk near Berkeley Way and Walnut Street. She alerted police. Officers responded and identified the man as 50-year-old Kenneth Kenji Stine. Police detained Stine and spoke to him that night but did not arrest him. State law does not permit officers to make an arrest for most misdemeanors [if they did not witness the crime](https://bluetogold.com/the-stale-misdemeanor-rule/?ref=berkeleyscanner.com), said BPD spokesman Officer Byron White. Police did, however, forward the case to the Alameda County district attorney's office for review. As public interest in the case has grown, White said some have asked why the man was not arrested for stalking. He explained that a stalking charge requires [harassment or some type of threat as well as repeated conduct](https://leginfo.legislature.ca.gov/faces/codes%5FdisplaySection.xhtml?sectionNum=646.9&lawCode=PEN&ref=berkeleyscanner.com), neither of which appeared to be present here. White said he also did not want to normalize criminal conduct or minimize the student's experience. "Having someone come into your apartment complex is alarming," White said. "We want everybody to feel safe." ![](https://storage.ghost.io/c/8e/3b/8e3bb516-9b88-46c2-aa85-566ed9c3647c/content/images/2026/09/Kenneth_Stine_BOK158.jpg) #### Kenneth Stine. **BPD* On Thursday, Contra Costa County entered a felony warrant into the system for Stine in an unrelated case involving an alleged violation of post-release community supervision, a form of [supervised release](https://www.cdcr.ca.gov/law-enforcement-resources/home/prcs/?ref=berkeleyscanner.com) similar to parole. At that point, Berkeley police began looking for Stine. They found him lying on the sidewalk at Shattuck and Ashby avenues Saturday afternoon, White said. BPD arrested Stine in connection with the warrant and the misdemeanor trespassing case, according to booking records. He is now at Santa Rita Jail being held without bail due to the felony warrant. The alleged trespassing violation carries $10,000 bail. According to court records, Stine has just one Alameda County criminal case, a misdemeanor charge of disobeying a court order stemming from a [UC Berkeley police arrest in June](https://www.localcrimenews.com/welcome/detail/101443363/kenneth-k-stine-arrest.html?ref=berkeleyscanner.com). His [broader arrest history](https://www.localcrimenews.com/welcome/searchArrests?firstname=kenneth&lastname=stine&city=&ref=berkeleyscanner.com) is extensive, however, including arrests outside Berkeley, according to public records. Earlier this year, he was charged with felony arson after a [fire at a Menlo Park coffee shop](https://www.kron4.com/news/bay-area/convicted-arsonist-pleads-not-guilty-to-menlo-park-coffee-shop-fire/amp/?ref=berkeleyscanner.com). He also has an arson conviction from Contra Costa County, KRON4 reported at the time. Writing on his Facebook page, Stine described "[hearing voices in my head continuously](https://www.facebook.com/kennethkenji.stine/)," which he attributed in 2021 to what he said was a secret DARPA program capable of reading and transmitting people's thoughts. He [posts regularly on his YouTube channel](https://www.youtube.com/@kennethkenjistinegod-s5e?ref=berkeleyscanner.com), where he identifies himself as "God." Speaking with NBC Bay Area over the weekend, students who live near campus described being followed home or finding trespassers in the area. "Honestly, [it's commonplace](https://www.facebook.com/watch/?mibextid=wwXIfr&v=1526388839173277) to hear that people are being followed," one young woman told the news station. "Not just women. Men, boys, girls of all ages." Winograd has now posted several follow-up videos on her TikTok page [criticizing the police response](https://www.tiktok.com/@edenwinograd/video/7687158171768524063?ref=berkeleyscanner.com) and calling for changes to the law so situations like hers can be taken more seriously. "You guys don't do anything until it's too late," she said. "This happens too often to too many people." She said she would investigate a restraining order, but otherwise wanted to get back to her "real life," with midterms looming. As of publication time, Stine had not yet been charged in the new case.
